Research Libraries Tell Publishers To Drop Their Awful Lawsuit Against The Internet Archive

I’ve seen a lot of people — including those who are supporting the publishers’ legal attack on the Internet Archive — insist that they “support libraries,” but that the Internet Archive’s Open Library and National Emergency Library are “not libraries.” First off, they’re wrong. But, more importantly, it’s good to see actual librarians now coming out in support of the Internet Archive as well. The Association of Research Libraries has put out a statement asking publishers to drop this counter productive lawsuit, especially since the Internet Archive has shut down the National Emergency Library.

The Association of Research Libraries (ARL) urges an end to the lawsuit against the Internet Archive filed early this month by four major publishers in the United States District Court Southern District of New York, especially now that the National Emergency Library (NEL) has closed two weeks earlier than originally planned.

As the ARL points out, the Internet Archive has been an astounding “force for good” for the dissemination of knowledge and culture — and that includes introducing people to more books.

For nearly 25 years, the Internet Archive (IA) has been a force for good by capturing the world?s knowledge and providing barrier-free access for everyone, contributing services to higher education and the public, including the Wayback Machine that archives the World Wide Web, as well as a host of other services preserving software, audio files, special collections, and more. Over the past four weeks, IA?s Open Library has circulated more than 400,000 digital books without any user cost?including out-of-copyright works, university press titles, and recent works of academic interest?using controlled digital lending (CDL). CDL is a practice whereby libraries lend temporary digital copies of print books they own in a one-to-one ratio of ?loaned to owned,? and where the print copy is removed from circulation while the digital copy is in use. CDL is a practice rooted in the fair use right of the US Copyright Act and recent judicial interpretations of that right. During the COVID-19 pandemic, many academic and research libraries have relied on CDL (including IA?s Open Library) to ensure academic and research continuity at a time when many physical collections have been inaccessible.

As ARL and our partner library associations acknowledge, many publishers (including some involved in the lawsuit) are contributing to academic continuity by opening more content during this crisis. As universities and libraries work to ensure scholars and students have the information they need, ARL looks forward to working with publishers to ensure open and equitable access to information. Continuing the litigation against IA for the purpose of recovering statutory damages and shuttering the Open Library would interfere with this shared mutual objective.

It would be nice if the publishers recognized this, but as we’ve said over and over again, these publishers would sue any library if libraries didn’t already exist. The fact that the Open Library looks just marginally different from a traditional library, means they’re unlikely to let go of this stupid, counterproductive lawsuit.

That's Amazing!

The anti-malaria drug that President Trump touted as a possible treatment for coronavirus, hydroxychloroquine, successfully lowered the death rate among hospitalized COVID-19 patients in the most recent study of the drug.

The large-scale analysis, conducted by Henry Ford Health System, was published Thursday in the peer-reviewed International Journal of Infectious Diseases.

The study examined 2,541 patients who had been hospitalized in six hospitals between March 10 and May 2, 2020.

More than twenty-six percent (26.4%) of patients who did not receive hydroxychloroquine died.

But among those who received hydroxychloroquine, fewer than half that number — 13% — died.

More than 90% of the patients received hydroxychloroquine within 48 hours of admission to the hospital. Scientists say giving the drug early during illness may be a key to success.

The study’s authors also found one concern flagged in previous reports about hydroxychloroquine did not materialize: heart-related adverse events.

"The data here is clear that there was benefit to using [hydroxychloroquine] as a treatment for sick, hospitalized patients," said Dr. Steven Kalkanis of Henry Ford Health System.

The study scientists point out that other reports about hydroxychloroquine as a treatment for coronavirus that had less positive, mixed, or negative results studied different populations; administered hydroxychloroquine later during illness; used different doses, and/or were not peer-reviewed.

President Trump was widely criticized in the media for saying that if hydroxychloroquine proves to work in treating coronavirus, it could be a game changer.

In May, he told reporters that he, himself, took a course of the drug as a preventive measure after several White House officials were diaagnosed with Covid-19. Trump says he suffered no ill effects from hydroxychloroquine.

Henry Ford Health System is also studying 3,000 healthcare and frontline workers to see if hydroxychloroquine can prevent coronavirus. That study is titled: "Will Hydroxychloroquine Impede or Prevent COVID-19" or "WHIP COVID-19."

However, the study scientists say negative publicity and safety concerns about hydroxychloroquine — some of which they say is inaccurate or out of context — has made it difficult to recruit enough volunteers to take part.

No. Criticism of Trump for claiming that it was some kind of wonder drug that will cure COVID patients and pushing it against then-current medical advice does not change just because some trials after the fact finds that it has some efficiency (though not the miracle cure he was claiming).

But, that is irrelevant now anyway, since the incompetence of this administration knows no bounds. Trump has managed to both encourage states to open their economies up way before they were ready, and has politicised the wearing of masks to such a degree that people are being attacked for either wearing one or telling customers to wear one. The result of this and other factors – the US is heading on a massive rise in infection that is going to cause a lot more Americans to die.

As of yesterday as I write this – the US has 57,238 new cases – a daily record – and shows signs of accelerating. Several states have already started locking back down and are reporting facilities already over capacity. People will die, and the snake oil your con man in chief was trying to sell won’t save you, even if it turns out it wasn’t just snake oil.

For contrast, life here where I live is pretty good, and mostly back to normal. Low daily cases, no spikes during carefully phased reopening, travel has opened up to a large chunk of the world (though we ban the plague rats from the US) and because people don’t argue with common sense things like insisting on some social distancing where possible and wearing masks where it is not, it should be a good summer.

Even if the "snake oil" is not "snake oil"? Is that a reasonable summary of your position? You wouldn’t take it because the it was "over-rated" by the Orange Monster?

Here’s a simple question – if you had Covid-19, based on this recent study, would you choose to take it or not?

I would do whatever a doctor – not a multi-time bankrupt con artist who couldn’t even run a casino profitably – advised me to do.

Of course it can. If the claims made during the sale do not match the actual effect of the drug, you’re selling it as snake oil, even if it does have some actual medicinal effects. Alex Jones, until he was recently told to stop lying by the FDA, was selling his supplements as cures for COVID. They absolutely were not that, but their combination of vitamins and minerals did have some real benefits. So, it was snake oil when compared to his claims, but not when compared to their actual properties.

It certainly can and by now I really shouldn’t be surprised that the average pro-trump troll keeps failing to reach the cognitive standards of five year olds.

See, Chloroquine is toxic. The side effects can be lethal.

In other words, self-medicating on chloroquine is likely more lethal than having Covid. And THAT is why the moron-in-chief’s suggestion of chloroquine being a miracle cure is as deranged an argument as advocating self-medicated chemotherapy and radiation as a cure for cancer.

Add as icing to the cake on this that in some cases chloroquine may have helped and in other cases not and what you have is the drug version of russian roulette where, unless you’re really up shit creek, you wouldn’t want to take chloroquine in the dosages assumed to be required without a whole team of expert surgeons standing by to tackle the side effects.

And that’s also why the loud orange in the white house is taking dosages of chloroquine WAY smaller than the dosages used in the emergency tests displaying positive results.

I almost wish he didn’t. Having him drop to the floor from intermittent extreme tachycardia, having seizures and/or vomit uncontrollable in front of the camera as a direct result of ingesting emergency dosages of chloroquine might help to show the Cult Of Trump their Great Fearless Leader was talking out of his ass again.

Then again it might not. With numerous actual deaths and hospitalizations from demented trumpers drinking chloroquine and chlorox as suggested by the orange combover clown it’s pretty telling the Trump Death Cult is still ready to take their dedication to their leader all the way.

1) it is dense and complicated enough that it requires some level of cognitive ability – maybe high school level, but not advanced placement high school level.

2) For those at high school level or higher, they can see right through your stupid arguments. Yes, taking any drug in the wrong dosage can be lethal. Drinking too much water can be lethal. Any idiot knows that. Current published and peer reviewed reports conclude without exception that this drug is a very effective treatment for the virus, and has saved many lives. Saved Lives. That’s the problem here. There are known side-effects of the drug, those side effects can in some cases be riskier than not treating, and encouraging hoarding will remove access to the drug from people who need it for non-COVID related conditions. The above study is one of many, and there are different results being reported, but the fact is that any recommendation is bad if it’s made before supporting medical evidence is available,

A sane, intelligent person would know this and not make any recommendations until it’s actually been . Sadly, Trump is not one of those people. Even if he’s vindicated 100% by medical evidence months later, it was highly irresponsible for him to make those pronouncements before the evidence was confirmed.

Hell, Congress barely has any actual leftists in it. The overwhelming majority of congressional Democrats are either centrists or right of center. Which, indeed, is one of the reasons why people were advising against the drug, as well as things like N95 masks. Hoarding from greedy assholes triggered by irresponsible leadership will cause shortages for people who already need them for non-COVID reasons.

A real leader understands this, and doesn’t make announcements until the clinical trials for COVID efficiency are complete, and/or there’s enough supply to guarantee every gets what they need (which, by the way, includes treatment for things like lupus in the US, so it’s not just overseas requirements being screwed).

Sadly, there’s no real leader in the White House, and an idiot who still thinks in terms of grifting and ratings.

Well, sort of, excepting all the tons of N95 masks we air-shipped to China for profit while SARS-CoV2 was already becoming a crisis in the States. It was not merely OK’d, but encouraged.

It’s fine to share, but this wasn’t sharing, and certainly other places could have used masks, as well as the States.

The figures as I check them this morning – still over 50,000 new infections reported a day. Being a lagging indicator, deaths haven’t started spiking significantly yet, but with reports of how badly over capacity some hospitals are in the US, that spike should be coming soon.

…and of course that’s just official figures. Some states are still trying to claim low COVID deaths while waving away the large rise in pneumonia deaths that just happen to be occurring at the same time.

The question is, does he hide enough to get re-elected, or does the next administration have competent leadership? Sadly, my guess is that it will still be a close race even after all of this, and if Biden gets in he’ll be blamed for everything Trump did wrong, as they blamed Obama for W.’s failed economy.

Yeah, quinine is an anti-malarial. Means it helps against the malaria parasite. Do we really need to inform you trumpers that a drug which works against one thing usually doesn’t work against another?

Boosting the dosages to many multiple times what is required to mitigate malaria has managed to…not actually kill covid patients in many cases, yes. Which is a good thing since chloroquine in those concentrations is so damn dangerous in its side effects.

Fun fact: None of these drugs will prevent contracting or transmitting the virus. Some may, or may not, decrease the death rate in severe cases, or shorten the hospital stay. Maybe.

So i really don’t know why the Trump fandom bangs on about this. (Well, OK, i do know, but it makes no sense, which i suppose is par for the course.)

Install Ubuntu, or one of its derivatives, or any other user orientated distro, and in and in less than 1 hour you have a working system complete with office applications, media player etc. Want more application, and there they are in an app store for you to install then from, and not one glimpse of the command line.

Also, I have a main machine running Debian testing, with updates most days, and not had any significant problems with it over the last six or seven years.

CSB: I recently had a need to scan some documents, but having recently moved from working in fully equipped offices to 100% remote work, the only scanner I have is one that’s over 10 years old. I tried it with my main MacOS Catalina system, only to find that support for the drivers was removed when they went full 64 bit and there’s no downloadable replacement. I’m fixing a Windows 10 laptop for someone, so I tried with that, same issue – drivers no longer supported. So, what do I do – install a VM with an older OS and hope that works, do I go and hunt down a friend whose scanner I can use, or do I bite the bullet and spend money I haven’t earned yet on a new scanner that I might not need again for another year?

Nope, I also had an Ubuntu 20.04 LTS stick lying around. Boot from that on my Mac, boom, scanner immediately fires up and I get the documents sent. No installation or command prompt needed. While the other OSes have simply stopped supporting my scanner due to long-term infrastructure changes, it seems that Ubuntu never stopped.

One thing I have come to like about Techdirt is how it presents such a sharp contrast to real life. For example, you speak about publishers with "more greed", which sounds similar to Obama talking about "greed". I never understood that before, but reading Techdirt, I’m starting to. When you see that Obama lives in multiple multi-million dollar mansions, and vacations on super-yachts, you don’t see greed, but when you see a small entrepreneur trying to offer a product or service for a fee, you do see greed. That’s so interesting. When you see all the conservative voices silenced (above), you see reasonable moderation and not political bias. You think moderation at scale is impossible, but Parler seems to do it fine and is satisfying millions of users, while you stay small and isolated, but content in your world view. When you see fake news, you take the stand that there is only one view that is fit to be published, and all others silenced, and you’re fine with that, and don’t see how totalitarian it is. When you see oppression by Police, you think of a systemic failure, rather than a few bad apples. The publishers might still try to kill off smaller libraries, though. All they would need to do for that is convince local governments that other things deserve more funding. Slash a few thousand dollars from a library’s budget every year and nobody will notice until the “closed due to lack of funding“ sign appears. That’ll make people angry, sure. If you want to keep libraries from shutting down, you have to get off your ass and push your government — at any and every level — to fund libraries better. If you want libraries to expand any efforts to modernize, you have to get off your ass and convince those blocking such efforts — like, say, publishing companies with a grudge against ebook lending — to get the hell out of the way.

You can ask for a savior to come along and do those things for you. But you’ll end up waiting forever for them to show up. Corporations won’t save you; neither will institutions. You can only save yourself. If you want to save libraries, you have to do the work. Neither God nor Google will do it for you.
